[vc_row][vc_column][vc_column_text]El Tribunal de Justicia de la Uni\u00f3n Europea<\/strong> ha fijado el pr\u00f3ximo d\u00eda 25 de febrero<\/strong> de 2019 para celebrar la vista oral sobre el \u00cdndice de Referencia de Pr\u00e9stamos Hipotecarios #IRPH\u00a0<\/strong>y responder a tres cuestiones prejudiciales planteadas por el Juzgado de Primera Instancia n\u00famero 28 de Barcelona:<\/p>\n

    \n
  1. La primera cuestiona si el \u00edndice IRPH est\u00e1 exento de cualquier control de transparencia<\/strong>, como afirm\u00f3 el Tribunal Supremo espa\u00f1ol\u00a0 en Sentencia de diciembre de 2017.<\/li>\n
  2. La segunda cuesti\u00f3n se refiere a c\u00f3mo quedar\u00eda el tipo de inter\u00e9s<\/strong>\u00a0del pr\u00e9stamo hipotecario en caso de que se decrete la nulidad del \u00edndice IRPH. Si ser\u00e1 referenciado a cero euros o si es sustituido por otro \u00edndice como el euribor.<\/li>\n
  3. La tercera deber\u00e1 aclarar si la devoluci\u00f3n<\/strong> de los importes pagados de m\u00e1s, junto a los intereses se aplican con car\u00e1cter retroactivo.<\/li>\n<\/ol>\n

    Hay que recordar que la Comisi\u00f3n Europea<\/strong> ya present\u00f3 en septiembre de 2018 un informe contrario al Alto Tribunal espa\u00f1ol\u00a0concluyendo que la cl\u00e1usula IRPH puede anularse de la hipoteca si no se comercializ\u00f3 con la debida transparencia.<\/p>\n

    Los m\u00e1s del mill\u00f3n de hipotecados afectados esperan con ansiedad la resoluci\u00f3n y la banca, al igual que con las cl\u00e1usulas suelo, vuelve a enfrentarse a uno de los mayores riesgos del sector financiero.<\/p>\n
